These terms of use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”, “your”) and Isac Designs BV (“we,” “us” or “our”), a company incorporated under Belgian law, with its registered office in Antwerp, Belgium, concerning your access to and use of www.isacstores.com (the “website”) as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

By accessing this website, you agree that you have read, understood, and agree to be bound by all these terms of use, including our privacy policy. If you do not agree with all these terms of use, please do not use this website.

Supplemental terms and conditions or documents that may be posted on this website from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these terms of use at any time and for any reason, with and without your notice.

It includes all additional information sheets, amendments, replacements and variations.  “Product” or “Item” means any goods, service, merchandise, offers or display available for sale on this website as well as the related description, information, warranties, delivery schedule or procedure.  “User”, “You”, and Your” refer to any individual or legal entity accessing or using our services on the website.  “Customer” refers to any user who accesses the website and makes a purchase of our products.

“We”, “Us”, and “Our” refer to Isac Designs BV-  www.isacstores.com – and refer to your contracting party when you use the site.  “Website” or “site” refers to “www.isacstores.com” and any related mobile app.  “Customer Account” means an electronic account created for the customer to purchase products offered on the website. “Terms’ refer to these terms of service, which are part of the agreement.

When you visit our website or send us emails, you are communicating electronically with Isac Designs BV. By doing so, you consent to receive electronic communications from us. Our representatives may communicate with you through email or within the website.

By purchasing products on our website, you expressly understand, acknowledge, and agree to be bound by the current agreement at the time of your order. This applies regardless of whether you are a registered user of Isac Designs BV.

You are only authorized to make a purchase through our website if you agree to comply with all applicable laws and the terms of this agreement. In addition to these terms, we recommend reading our Privacy Policy for information about how we collect, store, and protect your personal data when you make a purchase.

4. Intellectual property rights

Unless otherwise indicated, the site is our proprietary property and all of our trademarks, logo’s, designs, text, audiovisual works, copyrights and any all other intellectual property rights in all material or content contained within this website are owned or controlled by us or used by us under authorization of third parties. Except as expressly provided in these terms of use, no part of the site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

For instance, products listed on the website may be unavailable, have different attributes, or carry a different price than what was stated. We may also modify the pricing and availability of products without notice. We will rectify any pricing errors on the website once discovered.

Our website has numerous products and services, and despite our best efforts, some of them may have incorrect pricing. We will usually verify prices as part of our shipping procedures, so if the actual price is lower than our stated price, we will charge the lower amount when shipping the product to you. However, if the correct price is higher than the website’s price, we may, at our discretion, contact you for instructions before shipping the product or reject your order and notify you of the rejection. We will not provide the products to you at an incorrect (lower) price, even after sending an order confirmation or shipping confirmation, if the pricing error is obvious and could have been recognized by you.

We make every effort to display as accurately as possible the colors, features, specifications, and details of the products available on the site. However, we do not guarantee that the colors, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colors and details of the products. You recognize that the specific technical specifications and settings of your computer and its display may impact the accuracy of the product’s color and appearance shown on the website.

The website may contain typographical errors, inaccuracies, or omissions, including errors related to product pricing and availability or events that we promote. Some information may also be incomplete or outdated. We reserve the right to rectify any mistakes, inaccuracies, or omissions, even after an order has been placed, and to modify or update information without prior notice.

All products are subject to availability, and we cannot guarantee that items will be in stock.  We reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change.

8. Purchases and payment

We accept the following forms of payment: Apple Pay, Bancontact, Visa, Matercard, Paypall  You agree to provide current, complete, and accurate purchase and account information for all purchases made via this website. We may change prices at any time. All payments shall be in Euros and must be paid in Euros. If a product is listed at an incorrect price, we have the right to refuse or cancel any orders for that product, even if the order has already been confirmed or your credit card charged. If we cancel your order and your credit card has already been charged, we will issue a refund to your credit card account.

You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees, and you authorize us to charge your chosen payment provider for any such amounts upon placing your order.

If your order is subject to recurring charges, then you consent to our charging your payment method on a recurring basis without requiring your prior approval for each recurring charge, until such time as you cancel the applicable order. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.

Isac Designs BV reserves the right to cancel or modify any order placed through the website at any time. Whether the order has been confirmed or not and/or your credit card or other payment method has been charged or not. We will issue a credit to your payment method for the corresponding amount. We may limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address.

9. Order processing

To place your order, please follow the instructions on the website. When you place an order, you are making an offer to buy our products and services. We will send you an email to confirm that we have received your order (the “order confirmation”).

While we normally confirm orders by email, receiving an order confirmation email does not mean we have accepted your offer to buy a product or service. All orders are subject to our acceptance, which we will confirm by sending you an email confirming that your order has been shipped (the “shipping confirmation”). A contract between us is only formed when you receive the shipping confirmation. This contract only covers the products and services that we have confirmed in the shipping confirmation, and we are not obliged to supply any other products or services from your order.

10. Shipping information

Shipping will be made to the delivery address you provide, unless otherwise agreed. For delivery costs and expected delivery times, please refer to our Shipping Information. International customers are responsible for tax, customs and duties. All purchases from this website are made pursuant to a shipment contract. As a result, risk of loss and title for items purchased from this website pass to you upon delivery of the items to the carrier. You are responsible for filling any claims with carriers for damaged and/or lost shipments.

We aim to deliver your products by the estimated date specified in the shipping confirmation email, or within 30 days if no date is given. If we experience any delay within our control, we will keep you informed about the estimated new delivery date. Please note that if your product(s) is not delivered within 30 days of the shipping confirmation email, you have the right to cancel the order and receive a full refund. Products are considered delivered to you and at your risk once they are delivered.

Ownership of all ordered and/or delivered products remains with Isac Designs BV until the full purchase price has been received by us.

Shipping information and delivery times. There are three ways of shipping, mentioned below.

11. Return and refund policy

 At Isac, our mission is to provide you with a delightful shopping experience. We have carefully crafted the following return policy specifically for your Isac purchases. Kindly review the terms and conditions mentioned below:

• Eligibility for Returns:

We gladly accept returns of our Isac clothing within 14 days from the date of delivery. To be eligible for a return, the clothing item must be in its original, unused, unworn, and unwashed condition, with all original tags, labels and shipping bags intact.

Please note that our socks are non-refundable and non-changeable.

• Return Process:

To initiate a return, kindly contact our helpful customer service team within the 14 days from the date of delivery by sending an e-mail to info@isacstores.com with ‘RETURN + ORDER NUMBER’ in the subject. Please note it takes 2 – 3 business days to proceed your request. We will guide you through the seamless return process and provide you with any necessary instructions to ship your Isac items back to our warehouse.

When sending the item back to us, please ensure that it is securely packaged to prevent any damage during transit. You can bring your package to several drop off points that you can find an overview here.

Please also note that the customer is responsible for the delivery and all the shipping fees until it reaches Isac Designs’ BV Warehouse.

• Refund Options:

Once we receive and carefully inspect the returned Isac clothing, we will promptly notify you regarding the status of your refund.

If the item meets the eligibility criteria, you can select either a refund or an exchange for a different size, color, or style, subject to availability. In the case of a refund, the original payment method used during the purchase will be promptly credited. Kindly note that any applicable shipping fees are non-refundable.

• Return Shipping Costs:

The customer is responsible for the return shipping costs, except in situations where the return is due to a manufacturing defect, incorrect item received, or an error on our part. In such instances, upon verification, we will either provide a prepaid shipping label or reimburse the return shipping costs.

• Damaged or Defective Items:

If you receive an Isac item that is damaged or defective, kindly reach out to our customer service team immediately via info@isacstores.com with ‘DEFECT + ORDER NUMBER’ in subject. We will swiftly assist you in resolving the issue by offering a replacement, repair, or refund, based on your preference.

• Exchange Policy:

Exchanges are subject to product availability. If the desired item is not available, we will process a refund for the returned item, following the refund options mentioned above.

12. Prohibited activities

The website is to be used only for its intended purpose and not for any commercial activities unless approved by the website owners. Users are not allowed to engage in unauthorized collection of data, use the site to sell goods or services, or interfere with security features of the site. Users are also not allowed to use the site in any way that violates applicable laws or regulations.

13. Site management

We reserve the right, but not the obligation, to: 

1. monitor the site for violations of these terms of use;
2. take appropriate legal action against anyone who, in our sole discretion, violates the law or these terms of use, including without limitation, reporting such user to law enforcement authorities;
3. in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof;
4. in our sole discretion and without limitation, notice, or liability, to remove from the Site or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems;
5. otherwise manage the site in a manner designed to protect our rights and property and to facilitate the proper functioning of the site.

 

14. Limitations of liability

Isac Designs BV. and its suppliers, content providers, and advertisers, to the fullest extent permitted by law, explicitly disclaim all conditions, warranties, and other terms that may be implied by statute, common law, or any other applicable law. They shall not be liable for any damages unless expressly stated otherwise.

Isac Designs BV do not assume any responsibility for any indirect damages that may arise from the use of our products. Additionally, we are not liable for any delays or errors that occur due to circumstances outside of our control, such as labor disputes, fires, wars, government decisions, or supplier non-delivery. Please note that we cannot guarantee the accuracy, completeness, validity, or timeliness of any information provided by us or third parties. It is your responsibility to exercise caution and use your own judgment when evaluating any methods, offers, or information.

Moreover, we are not responsible for any direct or indirect losses or damages incurred by users of the www.isacstores.com website, including but not limited to loss of data or information, financial or physical harm. In no event shall www.isacstores.com its owner, directors, employees, partners, agents, suppliers, or affiliates be held accountable for any indirect, incidental, special, consequential, or exemplary damages resulting from (i) your use or inability to use the service, (ii) any conduct or content of any third party on the service, and (iii) any unauthorized access, use, or alteration of your transmissions or content, regardless of whether such damages are based on guarantee, agreement, domestic wrong (including carelessness), or any other lawful concept, and whether or not we were aware of the possibility of such damage.

These terms of use and your use of the site are governed by and construed in accordance with the laws of the Belgian applicable to agreements.
